An attorney’s representation of clients and interactions with parties is strictly governed by the profession’s rules of engagement: The Model Rules for Professional Conduct. For school attorneys, representing an organizational client presents unique challenges, especially in communication and client management. Attorneys advocating for students with disabilities face a similar conundrum, as they are asked to balance the rights and needs of the student at issue with the rights and needs of the parents who likely retained the attorney. The natural follow-up question is always complex no matter what client you represent: what duties do you owe that client? Attorney Bobby Truhe will highlight applicable provisions of the ethical code and explore relevant decisions and commentary in pursuit of answers to these intriguing questions.
